Vehicle Sale Agreement in Pakistan: What to Write and Sign
A written sale agreement protects both the buyer and the seller when a vehicle changes hands. It records who sold what, for how much, when the vehicle was handed over, and who is responsible from that point on. Without it, a later dispute about payment, condition, or a traffic fine becomes one person word against the other. This guide covers what to write, what to sign, and what the agreement does not do.
What the Agreement Is For
A vehicle sale agreement is a private written record of a deal. It proves that the seller agreed to sell a specific vehicle to a specific buyer for a specific price, and that the buyer accepted it on the stated terms. It is useful evidence if payment is disputed, if the condition at handover is questioned, or if a fine arrives for a period after the sale.
What it is not matters just as much. It is not registration transfer, it is not a guarantee about the vehicle history, and it does not change official records on its own. Many sellers learn this the hard way when fines keep arriving in their name months after a sale, because the buyer never completed the transfer. The agreement helps prove the deal happened, but only the official transfer changes the registered owner.
Buyer and Seller Details
Start with full, exact details for both parties, matching their identity cards. Short names and nicknames cause trouble later, so write everything in full.
- Full name of the seller and the buyer, exactly as on their identity cards
- Identity card numbers of both parties
- Current addresses and phone numbers of both parties
- If either party acts through someone else, the basis of that authority, recorded in writing
Check the identity cards in person at signing. A deal signed with a wrong name or a borrowed identity card is difficult to enforce and can leave the real owner exposed.
Vehicle Details
Describe the vehicle so precisely that it cannot be confused with any other vehicle. Do not rely on the model name alone.
- Make, model, model year, and colour
- Registration number and the city of registration
- Engine number and chassis number, copied carefully and checked against the vehicle
- Current mileage reading at the time of sale
- Known condition notes: dents, faults, or parts the seller has disclosed
Before signing, the buyer should verify the vehicle record with the relevant authority and inspect the vehicle in person. Our guide to verifying a used car before buying covers the checks to run before money changes hands.
Price, Payment, and Handover
Money and handover are where most disputes start, so record them in detail. Write the total price in figures and in words, so a changed digit cannot change the deal. Then record every payment: the amount, the date, and the method, whether bank transfer, pay order, or cash.
- Total sale price in figures and in words
- Advance payment, if any, with date and method
- Balance payment, with the date and method it will be paid by
- Date, time, and place of vehicle handover
- Keys, documents, and accessories handed over at that point
- A statement that responsibility for fines, challans, and use of the vehicle passes to the buyer from the recorded handover point
Bank transfer or pay order leaves a trace that cash does not. Whatever method is used, keep the receipts with the signed agreement, and note the payment references in the agreement itself.
What to Sign and How
- Both buyer and seller sign every page of the agreement, not just the last page.
- Two witnesses sign, with their full names, identity card numbers, and contact details.
- Each party keeps a signed original copy, with the same attachments.
- Any change after signing is written as a dated addition and signed again by both parties, never altered silently on the original.
- Thumb impressions may be added alongside signatures where the parties wish, but they do not replace the transfer procedure.
Sign in person, in one sitting, with the vehicle and its documents present. Signing separately, days apart, or without seeing the documents invites exactly the disputes the agreement is meant to prevent.
Documents to Attach
- Copies of the identity cards of buyer, seller, and witnesses
- The original registration book or card, or a copy where the original stays with the transfer file
- The transfer letter, where applicable to the registration city
- Token tax and clearance receipts the parties agree to include
- The inspection or verification record, if the buyer had one done
List every attachment in the agreement itself, so a missing document is obvious at once. For the costs that follow the sale, see our vehicle transfer fee estimator and our vehicle registration cost calculator.
What the Agreement Does Not Do
- It does not transfer registration. Only the official transfer with the relevant authority changes the registered owner.
- It does not clear unpaid token tax, fines, or liabilities from before the sale unless the agreement says so clearly.
- It does not guarantee the vehicle history, accident record, or mechanical condition beyond what is written in it.
- It does not protect a seller who never follows up on the transfer. After the sale, confirm that the transfer is actually completed, and keep proof of it.
Complete the official transfer promptly after signing, and keep the transfer receipt with the agreement. That pair of documents, the agreement plus the transfer proof, is what truly closes a vehicle sale.
Frequently asked questions
What details must a vehicle sale agreement in Pakistan include?
It should record the full names, identity card numbers, and addresses of buyer and seller, the complete vehicle details including make, model, year, engine number, chassis number, and registration number, the agreed sale price, the payment method and dates, the date and place of handover, and who is responsible for the vehicle from that point onward.
Does a sale agreement transfer ownership of a vehicle?
No. A sale agreement is a private record of the deal between buyer and seller, but it is not registration transfer. Ownership in official records only changes when the transfer is completed with the relevant excise and taxation department. Until that transfer is done, the seller may still appear as the registered owner in official records.
What documents should be attached to a vehicle sale agreement?
Attach copies of the identity cards of buyer and seller, the original registration book or card, the transfer letter where applicable, and any clearance or token tax receipts the parties agree to include. Both parties should keep a signed copy of the agreement and the same set of attached documents.
How should payment and handover be recorded in the agreement?
Write the total price in figures and words, each payment with its date and method, and the exact date, time, and place of handover. Note the condition of the vehicle at handover, the keys and documents handed over, and that responsibility for fines, challans, and use of the vehicle passes to the buyer from the handover point recorded in the agreement.
Should a vehicle sale agreement be signed in front of witnesses?
Yes, it is good practice for both parties to sign every page, and for two witnesses to sign with their full names, identity card numbers, and contact details. Witness signatures help if the deal is later disputed, but they still do not replace official transfer and registration, which must be completed separately with the relevant authority.
